Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the BizDash.ai platform and services provided by BizDash, Inc. (“BizDash,” “we,” “us,” or “our”). By accessing or using BizDash, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using the BizDash platform, you confirm that you are at least 18 years old, have the legal authority to enter into these Terms, and agree to comply with all applicable laws and regulations. If you are using BizDash on behalf of an organization, you represent that you have authority to bind that organization.

2. Account Terms

• You are responsible for maintaining the security of your account credentials.
• You must provide accurate and complete registration information.
• You are responsible for all activity that occurs under your account.
• You must notify us immediately of any unauthorized access to your account.
• One person or organization may not maintain more than one free account.

3. Acceptable Use

You agree not to use BizDash to:

• Violate any applicable law or regulation
• Infringe on the intellectual property rights of others
• Transmit malicious code, viruses, or harmful data
• Attempt to gain unauthorized access to other accounts or systems
• Interfere with or disrupt the platform's infrastructure
• Use the platform for any illegal, fraudulent, or deceptive purpose
• Scrape, crawl, or use automated means to access the platform without permission

4. API Terms

Access to the BizDash API is governed by your subscription plan. You agree to use the API in accordance with our API documentation and rate limits. We reserve the right to throttle or suspend API access if usage patterns indicate abuse or excessive load. API keys are confidential and must not be shared publicly.

5. Cancellation & Termination

• You may cancel your account at any time from your account settings.
• Upon cancellation, your data will be retained in read-only mode for 30 days, after which it will be permanently deleted.
• We may suspend or terminate accounts that violate these Terms, with notice where practicable.
• Termination does not relieve you of any obligation to pay outstanding fees.

6. Fees & Billing

• Subscription fees are billed in advance on a monthly or annual basis.
• All fees are non-refundable except as required by law or as stated in our refund policy.
• We may change pricing with 30 days' notice. Price changes will apply at the start of your next billing cycle.
• Failed payments may result in service suspension after a 7-day grace period.
• You are responsible for all applicable taxes.

7. Intellectual Property

BizDash and its original content, features, and functionality are owned by BizDash, Inc. and are protected by international copyright, trademark, and other intellectual property laws. You retain full ownership of all data you input into the platform. We claim no intellectual property rights over your business data.

8. Limitation of Liability

To the maximum extent permitted by law, BizDash shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, regardless of the cause of action. Our total liability shall not exceed the amount you paid to BizDash in the 12 months preceding the claim.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved through binding arbitration in San Francisco, California, except where prohibited by law.
